Terms of Service
Last Updated: October 22, 2026
These Terms of Service (“Terms”) govern your access to and use of Ableversity’s educational platform “AbleU” — including the AbleU web application, the AbleU iOS and Android mobile applications, the ableversity.com website and blog (together with our other related online services, the “Services”) — and the related Career Services and Hands-on Study Labs described below. Ableversity (“Ableversity”, “we”, “us”, “our”) is headquartered in the State of Georgia, USA.
We create and operate most of the educational content on the Services ourselves, with some content developed by third-party instructors. Our courses are also offered for sale on third-party marketplaces (including Udemy). Purchases made on those third-party marketplaces are governed by that marketplace’s own terms, not these Terms. These Terms govern your use of our own Services and direct purchases from us. We provide details about our processing of personal data in our Privacy Policy.
If you live in the United States or Canada, by agreeing to these Terms, you agree to resolve disputes with Ableversity through binding arbitration (with very limited exceptions, not in court), and you waive certain rights to participate in class actions, as detailed in Section P (Dispute Resolution).

A. Accounts
You need an account to enroll in courses, subscribe to a plan, or purchase services. You are fully responsible for all activity that occurs under your account, including if someone uses it without your permission. Keep your password secure, do not share your login credentials with anyone, and notify our Support Team immediately if you suspect unauthorized access. We may ask for information to confirm you are the account owner before restoring or changing access.
When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address.
You must be at least 18 years of age to create an account and use the Services. If we discover that an account was created by someone under 18, we will terminate it.
You may create or sign in to an account using a supported third-party identity provider (currently Google, LinkedIn, Facebook, Microsoft, Apple, and Steam). When you do so, you authorize the provider to share with us the profile information described in our Privacy Policy (such as your name, email address, and profile picture). The provider’s own terms and privacy policy also apply to your relationship with it. We do not otherwise access, read, or scrape your accounts on any third-party platform.
You may not transfer or sell your account, and your account cannot be used by someone else. All rights to your account terminate upon your death, at which point the account will be closed.
We may suspend or terminate your account, with or without notice, for a violation of these Terms, non-payment, suspected fraud or illegal activity, extended inactivity, requests from law enforcement or government agencies, or in our sole discretion. Upon termination we may delete your account and content, and prevent further access, and your content may remain visible where others have copied or shared it. To terminate your account yourself, follow the steps in our Support Center or contact us; see our Privacy Policy for what happens to your data when you terminate.
B. Subscriptions, Trials, Payments, and Refunds
The Services offer a free tier, paid membership plans (including a veteran plan), one-time course purchases, and paid add-on services: Hands-on Study Labs (Section F) and Career Services (Section E). Available plans and pricing are shown at checkout and may vary between the web application and mobile application stores due to store pricing rules. We may run promotions; the price at checkout governs your purchase.
We offer a free trial for new subscribers. A trial gives you paid-tier access until its end date. A trial does not automatically convert to a paid subscription: when the trial ends, your access reverts to the free tier unless you actively choose a paid plan. If you choose a paid plan, it is billed according to the terms in the next item.
Paid plans and the Study Lab add-on are billed monthly or annually (as you select) and renew automatically at the end of each billing period until you cancel. You may cancel at any time: on the web and for credit-card billing through your account settings (processed via Stripe), and for purchases made in the Apple App Store or Google Play through your device’s subscription settings, in which case Apple or Google administers the subscription and its refund policy. Cancellation takes effect at the end of the current billing period; you keep access until then. We may change prices for future billing periods; we will notify you of material price changes before they take effect.
If your payment method fails, we may suspend access to the affected service after notice, and you remain responsible for the corresponding fees.
If you are located in a jurisdiction where sales tax, GST, or VAT applies to consumer sales, we collect and remit that tax. Depending on your location, the price you see may include such taxes or tax may be added at checkout.
- One-time course purchases: you may request a refund within 30 days of purchase following the steps in our Support Center. We may apply your refund to your account as credit or to your original payment method at our discretion. If a course you purchased is disabled for legal or policy reasons, you are entitled to a refund beyond the 30-day limit.
- Subscriptions and add-ons: refunds for the current billing period are generally not available. You may cancel at any time as described above and retain access through the end of the paid period. Refunds for in-app purchases made through the Apple App Store or Google Play are handled under Apple’s or Google’s consumer policies.
- Career Services: purchases are generally final, except where the applicable service description states otherwise, where we fail to deliver the service, or as required by applicable law.
- Abuse: we may deny refunds we believe to be abusive (for example, repeated refund requests or refunds after significant consumption of purchased content) and may restrict or ban accounts that abuse our refund policy.
If we ban or terminate your account for violating these Terms, you will not be eligible for a refund.
We may from time to time offer credits on your account (for example, credits usable toward Study Lab usage or promotional credits). When credits are offered, they are governed by our Credit Terms, which are incorporated into these Terms. Gift and promotional codes follow the terms included with the code and may expire.
C. Course Content and Your License
We grant you a limited, non-exclusive, non-transferable license to access and view courses and associated content you have enrolled in, solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms. Courses are licensed, not sold. You may not reproduce, redistribute, transmit, sell, broadcast, rent, lend, modify, create derivative works of, record, stream, or otherwise use any course content for any other purpose, including sharing your account or downloading content for distribution.
Courses acquired through a one-time purchase are available for your lifetime. Access to content included in a subscription plan continues while the plan is active (and, for one-time purchases, for your lifetime). We reserve the right to disable a course at any time if we determine or are obligated to do so for legal or policy reasons (for example, a valid copyright complaint or a violation of our content rules); affected purchases are refundable as described in Section B.5. Access to add-on features (such as caption and translation options) and any instructor-provided assistance are not included in lifetime access.
Some courses, narration audio, and multilingual caption tracks (currently 26 languages) are produced with the assistance of automated tools (speech synthesis, automatic transcription, and machine translation), which we review before publication. All content, whether human-produced or AI-assisted, is provided on an “as is” basis without any warranty of accuracy, as described in Section L.
Some course content is produced by third-party instructors (Section H). We do not exercise editorial control over instructor content and do not guarantee its accuracy or legality. You rely on any information provided in such content at your own risk.
D. ACE Credentials
When you complete a course exam that qualifies, we may issue an ACE credential — a recognition badge issued by Ableversity that reflects your results with our courses and exams.
ACE credentials are not Splunk certifications, and are not certifications issued or endorsed by any software vendor. They are not a substitute for, and may not be represented as equivalent to, any official vendor certification. We do not guarantee that completion of our courses or an ACE credential will help you pass any vendor certification or achieve any career outcome.
E. Career Services and Candidate Spotlight
We offer paid, human-delivered Career Services, which may include mock interviews (with a written report), resume reviews, LinkedIn profile reviews, on-demand expert sessions, and bundles of these services. These are professional advisory services delivered by Ableversity personnel. To receive a service you may provide intake materials as requested (for example, a resume file, your LinkedIn profile URL, and notes); see our Privacy Policy for how we handle them. Sessions you book are scheduled through Calendly, a third-party booking service whose own terms apply to the booking.
Career Services provide information and professional feedback only. They do not constitute job placement services and do not guarantee any outcome, including hiring, salary, promotion, or certification success.
From time to time, if you purchase the applicable service, we may invite you to take part in “Candidate Spotlight”: sharing your learning story publicly. Participation is entirely optional. If you take part, you will be asked to check specific consent boxes for each item we may use (such as your name, photo, story answers, or before/after resume or LinkedIn snippets) and for each distribution channel (including AbleU, our website, and our social media accounts on LinkedIn, Instagram, Facebook, X, and TikTok). We will only use the items and channels you consent to, and you may always request changes or withdraw your consent. Upon withdrawal, we will remove your personal content from our channels and records — including from third-party platforms where we control the posting — within a reasonable period (up to 30 days), subject to platform caching and the fact that copies already shared by others cannot be controlled by us. We retain your consent and approval records as legal artifacts even after your content is purged.
F. Hands-on Study Labs
The Study Lab add-on provisions a dedicated, single-user cloud instance (hosted on Amazon Web Services) preloaded with a Splunk evaluation-license installation, plus a subscription plan tier (for example Starter, Standard, or Pro) that determines allowed usage. The installation is periodically re-provisioned (monthly) to refresh Splunk’s 60-day evaluation license. We may stop idle instances, snapshot and restore them, and collect basic usage and health telemetry to operate the service.
Your Study Lab instance is accessible over the internet and is under your control once provisioned. You are responsible for: (a) all data and activity on your instance; (b) protecting the administrator credentials we provide (which must never be shared); (c) complying with applicable law; and (d) complying with the terms of the Splunk evaluation license, which is provided to you for personal evaluation purposes only and may not be used in production, distributed, or sublicensed.
The Study Lab is provided “as is” and “as available” without any service-level guarantee; we may interrupt, re-provision, or terminate lab access for operational or policy reasons. You may not use a Study Lab to attack, scan, or overload other systems; to distribute malware; to process third-party production data; or in any other abusive or unlawful manner. Violations may result in immediate lab termination and action against your account.
We are not a reseller or distributor of Splunk software or licenses, and we are not affiliated with Splunk Inc. The evaluation license is subject to Splunk’s own license terms.
G. Community Features and Referral Program
For many lessons you may ask questions and answer other users’ questions, post and moderate course reviews, earn points (“karma”) and badges, and appear on leaderboards. This content is visible to other users and is subject to our moderation, your obligations under Sections I and J, and your Privacy Policy choices.
We operate a referral program in which you may invite others using your referral code and both parties may receive promotional rewards (such as a first-purchase discount code, and credits where credits are made available). Rewards are governed by the program rules shown in the app at the time of offer and are non-refundable and non-transferable. Spam, self-referrals, and fraudulent referral activity void rewards and may lead to account action. Our external community is hosted on Slack, a third-party platform governed by Slack’s own terms.
H. Marketplace and Instructors
Some course content on the Services is created, owned, and submitted by third-party instructors. Instructors grant us the rights necessary to host and distribute their courses as part of the Services, and students receive their license to view through Section C only. Instructors may not grant licenses to their courses to students directly or through third-party marketplaces in a way that circumvents the platform; direct grants that conflict with the Terms applicable to the platform in question are of no effect here.
Where we pay instructors for content, those payments are governed by a separate written agreement between Ableversity and the instructor and are not covered by these Terms.
Courses we (or our instructors) sell on third-party marketplaces such as Udemy are sold subject to that marketplace’s terms of use and refund policies. These Terms do not govern purchases made on those marketplaces, though our Privacy Policy continues to govern our processing of your personal data.
I. Content and Behavior Rules
You may use the Services only for lawful purposes and in compliance with applicable local and national laws. You are solely responsible for the content you post or submit (including questions, answers, reviews, and documents) and for the consequences of it. You agree not to upload content whose export is restricted under applicable export-control regulations (including the U.S. Export Administration Regulations), and you may not use the Services if you are located in or resident of a territory where U.S. businesses are prohibited from doing business or are designated a Specially Designated National, Denied Person, or Denied Entity by the U.S. government.
These Terms do not grant permission for you to access or use the Services, directly or indirectly (including through third parties or other accounts): (a) on behalf of, for the benefit of, or as an employee, officer, director, contractor, attorney, agent, or other representative of Cisco Systems, Inc., Splunk Inc., or any of their current or former subsidiaries, affiliates, or successors-in-interest; or (b) if you are employed by, engaged by, or acting on behalf of any person or entity primarily engaged in developing, marketing, promoting, or reselling products, services, training, or certification materials that compete with the Services or any part of their content (including other Splunk, data-analytics, observability, or certification-training providers); or (c) for the purpose of analysing, benchmarking, reproducing, or informing the design of competing products, courses, or certifications, or evaluating the Services or their content for any purpose other than personal study — in each case unless we have given prior written consent.
A breach of this Section is a material breach of these Terms and a use of the Services outside the scope of the license granted in Section C. We may suspend or terminate the associated account immediately, without notice and without refund or credit (including for any third party who knowingly provides access to you or uses you to obtain such access). Nothing in this clause restricts your rights under applicable law (including as a consumer or whistleblower) or your use of public, non-confidential information.
You may not:
- access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our providers;
- disable, interfere with, or circumvent any security or access-control feature, or probe, scan, or test the vulnerability of our systems;
- copy, modify, reverse engineer, reverse assemble, or attempt to discover the source code of the Services (except where expressly permitted by law);
- access or search the Services by any automated means other than the search features we provide (no scraping, spidering, robots, or similar automated access);
- use the Services to send deceptive or false source-identifying information, interfere with or disrupt the Services or any user’s access (including by sending viruses, overloading, flooding, spamming, or mail-bombing); or
- impersonate any person or entity, or misrepresent your affiliation with any person or entity.
If your content or behavior violates these Terms, applicable law, or the rights of others (including intellectual property or image rights), we may remove the content and take any action described in Section A.6, in our sole discretion. We comply with applicable copyright laws and respond to valid infringement notices sent to the contact below.
J. Your Content and License to Us
You retain ownership of the content you post or submit (questions, answers, reviews, uploaded documents, and similar content). By posting such content you grant us a worldwide, non-exclusive, royalty-free license to host, copy, reproduce, store, display, and transmit it solely as needed to provide and operate the Services, make it visible to other users where the feature is public, store it in our backup systems, and comply with law.
Your submission to Candidate Spotlight is governed exclusively by the specific consents you provide under Section E.3, not by this general license. You represent and warrant that you have all rights necessary to submit any content you provide.
Any feedback, comments, or suggestions you provide about the Services is entirely voluntary, and we are free to use it without any obligation or compensation to you.
K. Ableversity’s Intellectual Property
All right, title, and interest in and to the Services — including the websites, apps, code, APIs, databases, branding, and content created by our employees — is and remains the exclusive property of Ableversity and its licensors, protected by copyright, trademark, and other laws of the United States and foreign countries. Nothing in these Terms grants you any right to use the Ableversity or AbleU names, logos, or other brand features. All course content we produce (including AI-assisted content) is our work product, subject to the student license in Section C.
L. Disclaimers and Risk
THE SERVICES AND THEIR CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE AND OUR AFFILIATES, SUPPLIERS, PARTNERS, AND AGENTS MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, SECURITY, LACK OF ERRORS, OR ACCURACY OF THE SERVICES OR THEIR CONTENT, AND EXPRESSLY DISCLAIM ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOU WILL OBTAIN ANY SPECIFIC RESULT (INCLUDING PASSING ANY CERTIFICATION, OBTAINING EMPLOYMENT, OR ACHIEVING ANY CAREER OUTCOME) FROM USING THE SERVICES. YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
We may change or discontinue any feature of the Services at any time and for any reason, and we are not liable for any interruption or unavailability. We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of war, natural disaster, network or power outages, or government action.
When you interact with other users or instructors we are not responsible for their conduct, and we are not liable for disputes, claims, losses, or damages arising from user-to-user interactions. You should exercise caution about personal information you share with other users. The Services contain links to third-party sites we do not control (including third-party marketplaces, Calendly, and Slack); we are not responsible for their content or data practices — read their terms and privacy policies.
M. Liability and Indemnification
TO THE EXTENT PERMITTED BY LAW, WE AND OUR GROUP COMPANIES, SUPPLIERS, PARTNERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES) ARISING FROM YOUR USE OF THE SERVICES, WHETHER IN CONTRACT, WARRANTY, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU UNDER ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify, defend (if we so request), and hold harmless Ableversity and our group companies, and their officers, directors, employees, suppliers, partners, and agents, from and against any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from (a) the content you post or submit, (b) your use of the Services, (c) your violation of these Terms, or (d) your violation of any third party’s rights. This obligation survives termination of these Terms and of your use of the Services.
N. Trademarks and Non-Affiliation
Splunk and all related trademarks, service marks, logos, and certification names (including any “SC” certification designations) are property of Splunk Inc. Ableversity is a third-party training provider and is not affiliated with, endorsed by, sponsored by, or connected to Splunk Inc. Our courses, ACE credentials, reports (including the “SplunkAbility” report), and services are independent, are provided for educational and training purposes only, and do not imply any endorsement by or relationship with Splunk Inc. Vendor certification exams, where referenced, are administered solely by the vendor or its authorized testing providers. Use of the Services by certain persons associated with Splunk Inc. or Cisco Systems, Inc. and by competitors is further restricted as set out in Section I.2.
O. Miscellaneous Legal Terms
By registering, accessing, or using the Services, you agree to be bound by these Terms (including the Privacy Policy, the Credit Terms, and any policies linked from them), which together constitute the entire agreement between you and us. If you are using the Services on behalf of a company or other entity, you represent that you are authorized to bind it. Any non-English version of these Terms is provided for convenience; the English version controls in case of conflict. If any provision is found invalid or unenforceable, it will be replaced by a valid provision that most closely matches its intent, and the remainder remains in effect. No delay or failure to exercise any right is a waiver of it.
The following survive expiration or termination of these Terms: Sections C (to the extent licenses were granted), D, E.3, J, K, L, M, N, O, and P.
These Terms are governed by the laws of the State of Georgia, USA, without reference to its conflict-of-laws principles. Except where Section P applies (and except for either party’s right to bring a claim in small claims court under Section P), you and we consent to the exclusive jurisdiction and venue of the federal and state courts located in Georgia, USA.
No action arising out of or relating to these Terms may be brought by either party more than one (1) year after the cause of action has accrued. Any notice under these Terms must be in writing and given by registered or certified mail (return receipt requested) or by email (from us to the email associated with your account; from you to support@ableversity.com or legal@ableversity.com).
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship. You may not assign or transfer these Terms; we may assign them without restriction. Nothing confers rights on any third party.
P. Dispute Resolution (United States and Canada)
This Section P applies only if you live in the United States or Canada. Before bringing any formal legal claim, please first contact our Support Team; most disputes can be resolved informally.
Either of us may bring a claim in small claims court in (a) Georgia, USA; (b) the county where you live; or (c) another location we both agree on, so long as the claim qualifies for that court.
If we cannot resolve a dispute amicably, you and Ableversity agree to resolve any claim arising out of or relating to these Terms or our other legal terms through final and binding arbitration, regardless of the type of claim or legal theory. A party electing arbitration initiates proceedings by filing an arbitration demand with the American Arbitration Association (AAA), governed by the AAA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer-Related Disputes. Either of us may ask a court to compel arbitration or to stay a court proceeding while arbitration is pending.
Claims under $10,000 USD must be resolved exclusively through non-appearance-based binding arbitration (by telephone, online, or written submissions, at the choice of the party seeking relief), with no personal appearance by the parties or witnesses unless both agree. Claims of $10,000 USD or more are resolved per the AAA Rules as to hearings. A judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
You and we agree that we may bring claims against each other only on an individual basis. Neither of us may bring a claim as a plaintiff or class member in a class, consolidated, or representative action; an arbitrator may not combine multiple people’s claims into a single case; and an arbitrator’s decision in one person’s case affects only that person. If a court determines this class-action waiver unenforceable, this Section P is null and void, but the rest of these Terms remain in effect.
Notwithstanding Section Q, if we change this Section P after the date you last accepted these Terms, you may reject the change by sending written notice of rejection by email from the email address associated with your account to legal@ableversity.com within 30 days of the change becoming effective. The notice must include your full name and clearly state your intent to reject the change. By rejecting, you agree that disputes will be arbitrated under this Section P as of the date you last accepted these Terms.
Q. Updating These Terms
We may update these Terms from time to time to clarify practices or reflect new features. If we make a material change, we will notify you by prominent means (such as email to the address on your account or an in-app notice) with a summary of the key changes. Changes become effective when posted unless stated otherwise, and your continued use of the Services after the effective date means you accept the changes. Revised Terms supersede all prior Terms, except that changes to Section P are subject to your rejection right under Section P.4.
R. How to Contact Us
The best way to reach us is through our Support Team or by email at support@ableversity.com. Legal notices may be sent to legal@ableversity.com. We are located in the State of Georgia, USA.
